1. Use of the National End of Life Care Programme website
1.1 This page tells you the terms upon which
you may make use of our website www.endoflifecareforadults.nhs.uk
(our site). By entering our site, you indicate
that you accept these terms of use and that you agree to abide by
them. If you do not agree to these terms of use, please refrain
from using our site.
1.2 Users must only use the site for lawful
purposes, and in a manner which does not infringe the rights of, or
restrict or inhibit the use of the site by any third party.
1.3 Users must not attempt to impair the running
of the site or corrupt its content. In such circumstances, NEoLCP
will inform the police where it deems it appropriate.
2. Intellectual property rights
2.1 NEoLCP are the owner or the licensee of all
intellectual property rights in our site, and in all publications,
leaflets, dvds, podcasts, film clips, guidance, training materials,
handbooks, products, materials, tools or any other materials
published on it (materials). Those materials are
protected by copyright laws and treaties around the world. All such
rights are reserved.
2.2 You must not modify in any way the paper or
digital copies of any materials you have printed off or downloaded
from our site without prior notification to NEoLCP of the nature
and content of such modifications.
2.3 Our status (and that of any identified
contributors or licensors) as the authors of material on our site
must always be acknowledged. Where certain materials on our site
specify the form of acknowledgment required, you must comply with
the same.
2.4 You must not use any product or material on
our site for the purposes of financial or commercial gain,
including, without limitation, sale of the products or materials to
any person.
2.5 If you print off, copy or download any part
of our site or any materials in breach of these terms of use, your
right to use our site will cease immediately and you must, at our
option, return or destroy any copies of the materials you have
made.
3. Advertising
NEoLCP receives no support through advertising or sponsorship
and will not accept any advertising on the website.
4. Liability
4.1 Whilst reasonable efforts have been made to
ensure the accuracy of the information and materials on our
website, we cannot guarantee their correctness or completeness. The
information and materials on our site are subject to change and we
cannot guarantee that they are up-to-date.
4.2 The purpose of the content and materials on
our site is to support health and social care staff in enabling
access to know-how and knowledge. In particular, all materials
which are available for download on our site are intended for use
by, or in conjunction with advice from, appropriately qualified
health and care professionals and any implementation should be
subject to the reader's professional judgment. Please also note
paragraph 4.3 in this respect.
4.3 Notwithstanding clause 4.2, commentary and
other materials posted on our site are not intended to amount to
advice on which reliance should be placed. NEoLCP does not accept
any responsibility or liability for any action taken or not taken
on the basis of such commentary or materials. In particular, but
without limiting the above, the role of NEoLCP is not to substitute
for the role of health professionals or professional carers, and
members of the public are therefore urged to consult with a health
or care professional for answers to any questions related to their
health or other care.
4.4 Without prejudice to paragraphs 4.1, 4.2 and
4.3 above, we hereby expressly exclude (to the extent permitted by
law):
- All conditions, warranties and other terms which might
otherwise be implied by statute, common law or the law of
equity.
- Any liability for any direct, indirect or consequential loss or
damage incurred by any user in connection with our site or in
connection with the use, inability to use, or results of the use of
our site, any websites linked to it and any materials posted on
it.
- Liability for any claim, liabilities, costs, proceedings,
damages and expenses awarded against, or incurred or paid by, you
as a result of or in connection with any claim made against you in
respect of the alleged or actual infringement, whether or not under
English law, of any third party's intellectual property rights in
respect of any materials.
4.5 This paragraph 4 is not intended to
restrict or exclude liability for death or personal injury caused
by our own negligence, nor our liability for fraudulent
misrepresentation, nor any other liability which cannot be excluded
or limited under applicable law.

All links from this website are provided for information only. A
link does not imply endorsement of that site. We do not accept
responsibility for the sites linked to, or the information
displayed there.
6. Linking to the NEoLCP website
Users are welcome to link to the NEoLCP site. Links to the site
are also subject to the material being reproduced accurately and
not being used in a derogatory manner or in a misleading context,
and that the source (including URL) must be acknowledged.
7. Privacy
We respect and are committed to protecting your privacy. This
Privacy Policy lets you know how any personal information is
processed and used by NEoLCP.
- We do not monitor individual usage of the library. Cookies and
session ids may be issued but these do not contain personal
information.
- We collect site usage statistics from our server logs. This
data helps us to manage and plan services, and will be used as part
of the evaluation of the NEoLCP site. Site usage statistics contain
no personal information.
- If you send us an enquiry you may include personal information.
This may be stored in a helpdesk database by the NEoLCP. Personal
data is used only to enable us to contact you, and is not used for
any other purpose.
8. Jurisdiction and applicable law
8.1 The English courts will have exclusive
jurisdiction over any claim arising from, or related to, a visit to
our site.
8.2 These terms of use and any dispute or claim
arising out of or in connection with them or their subject matter
or formation (including non-contractual disputes or claims) shall
be governed by and construed in accordance with the law of England
and Wales.
9. Variations
We may revise these terms of use at any time by amending this
page. You are expected to check this page from time to time to take
notice of any changes we made, as they are binding on you.
